Preamble

Welcome to CheckMeIn, an application that allows you to check-in to events and helps you verify your participation to different happenings based on your location, allowing you to connect and communicate with other participants via the ad-hoc social media network of the event.

To create your profile and use the application a certain amount of personal data is collected. Some of it is automatically collected, and the rest is collected directly by you. The collection and processing of your personal data by the application is always in line with our legal obligations, in compliance with the GDPR 2016/679, and the applicable law on privacy and data protection.

In this Notice you will find a detailed presentation of the reasons and the purposes for which we collect and process personal data, the ways we process it, as well as for how long we retain your data and how we protect it. You will also be informed about who has access to your data, what rights you have on your data and how you may exercise them. We encourage you to read our Privacy Notice thoroughly, as it reflects the Privacy and Data Protection Policy we follow. THIS IS AN ALPHA VERSION OF THE APPLICATION. THIS VERSION IS SOLELY INTENDED TO BE USED FOR TESTING PURPOSES, FOR THE FURTHER DEVELOPMENT OF THE APPLICATION. ONLY THE SELECTED TESTERS ARE INVITED TO USE THE APPLICATION TO PROVIDE FEEDBACK. THESE NOTICE DOES APPLY TO THE USE OF THE APPLICATION, REFLECTING THE PRIVACY POLICY WE FOLLOW. YET, IT WILL UPDATED AND AMMENDED WHEN THE APPLICATION FULLY LAUNCHES TO REFLECT THE FUNCTIONS AND FUNCTIONALITIES OF THE APPLICATION AND THE SERVICE.

1. Owner of the Application

This application is developed, owned, and administered by HYBRIDVERSE ANALYTICS P.C. (hereafter “the Owner”, “we”, “us”, “our”), formally founded under Greek Law as a Private Capital Company (GEMI Number 175761703000 – VAT Number 802404655) located in Greece, Mavromataion 95-97, Athens, 11472 (land line: +30 210 820-3953 e-mail: kostas.toulis@checkmein-app.com)

2. Our Service

2.1. Our service consists of (1) a platform licensed to various kinds of event organizers, and (2) this application available to anyone via mobile applications stores.

2.2. The application allows people participating in events that are using the platform provided from CheckMeIn P.C. for their participation registry, electronically check-in to the event as soon as they arrive at the event location, allowing secure verification of their presence at the designated place at the designated time, using spatio-temporal data from their mobile phone device.

2.3. The application also allows participants who wish to do so to participate in the ad-hoc social media network of the event and communicate in real time with all other participants who are also there, as well as with the organizers, sharing text messages.

2.4. Participation to the ad-hoc social media network of the event is completely optional, and does not require having a profile in any social media network.

3. Permitted Use

3.1. Downloading and using the application is free of charge.

3.2. Your permission to use our Service depends on the acceptance of and compliance with these Terms, the proper use of the service as described in these Terms.

3.3. Although there is nothing on the application that may negatively affect children or young people, nor content that may be deemed harmful to minors, the application is primarily intended for adults, and/or persons who are at least 16 years old. By browsing or using the Site you are assumed to be at least 16 years old. (For the collection and process of minors’ data through our application please see our Privacy Notice.)

3.4. Subject to your compliance with these Terms, upon subscription, we grant you a non-exclusive, non-transferable, revocable license to access and use our Service solely for the purpose of checking in and participating to an event that uses the CheckMeIn platform, as well as the communication affordances the application offers.

3.5. Additionally, for your usage of our Service to be permitted you thereby represent and warrant that using the application you will not in any way:

  1. distort, negatively affect and/or harm the functionality of the application and/or the CheckMeIn platform, and the access of others to the application and/or the CheckMeIn platform;
  2. install, promote, and/or give access to content that contains viruses, malware, or any other files, code, or software designed to intercept, destroy, and/or restrict or otherwise restrain or interfere with the functionality of any software, hardware, or broader ICT component or in any way prevent other users from using the application;
  3. install, distribute or otherwise disseminate any kind of automated or not, pop-up, temporal or persistent, targeted or random unauthorized advertisement or any kind of unauthorized marketing material or unsolicited or undesired electronic messages (spam), pyramid systems or any other kind of unauthorized and undesired content, product or services marketing/promotional material, without the prior explicit, written authorization of the Owner;
  4. spread any type of misinformation and/or fake news, related but not limited to the event, the functionality of the application, the purpose of the application, and/or the identity and reputation of the Owner;
  5. transmit content that does not adhere to the law, infringes upon the legitimate rights and interests of others, and/or is contrary to fair practice and/or the accepted principles of public order and morality;
  6. transmit content that ridicules, mocks, disparages, intimidates, harasses, abuses, or threatens, any other person, or group of people, and does not promote violence against a specific person or class of people;
  7. transmit content that includes offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap;
  8. transmit comments that violate any applicable law, regulation, or rule.

3.6. Any use of the Service in violation of the foregoing violates these Terms and may result in, among other things, suspension of your right to use the Service, and/or the obligation to provide compensation to the Owner.

4. Updates, changes, upkeep, and maintenance

4.1. We will make every reasonable effort keep our Service available to you at all times. However, we cannot guarantee that the Service will be available at all times.

4.2. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors.

4.3. You agree that we have no liability and we will provide no compensation whatsoever for any loss, damage, or inconvenience caused by your inability to access the Service during any downtime.

4.4. We reserve the right to change, modify, or remove some or all of the functionalities offered along with the Service, and/or discontinue the Service at any time.

4.5. You agree that we have no liability and we will provide no compensation whatsoever for any loss, damage, or inconvenience caused by changes, alterations, modifications, the removal of some or all of the functionalities of the application, or the discontinuation of the Service.

5. Content Copyrights and Licensing Agreements

5.1. The application is the exclusive intellectual property of CheckMeIn P.C.

5.2. All the content and functionalities offered to you are owned by or licensed to us, to be used within the limited scope of the permitted used as described in section 3. Permitted Use. As such, we, together with our licensors, own and control all the copyright and other intellectual property rights.

5.3. We respect the intellectual property of others. If you believe that any material available through our Service infringes upon any copyright you own or control, please immediately notify us. We shall take immediate action and all reasonable measures to stop the infringement.

7. Disclaimer

7.1. The application along with all the material and functionalities offered are provided on an as-is and as-available basis, and the Service is offered on a best-effort basis.

7.2. You agree that your use of the service will be at your own sole risk.

7.3. To the fullest extent permitted by law we disclaim all warranties expressed or implied in connection with the Service, the material and functionalities provided and your use thereof.

7.4. We make no warranties or representations about the accuracy, completeness, or availability of the Service, or accessibility to the application or the Service, and we will assume no liability or responsibility for any interruption of the Service, any unauthorized access to or use of our website or Service, along with any type of usage of our Service that does not fall under the Permitted Use section of these Terms, any bags viruses Trojan horses or the like which may be transmitted to or through the services by any third party, any errors or omissions in any content and materials, or any loss or damage of any kind incurred as a result of the use of any content posted transmitted created or otherwise made available via our service.

7.5. We do not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party, including but not limited to the event organizers that use the HYBRIDVERSE ANALYTICS P.C. platfrom.

8. Limitation of Liability

8.1. In no event will we be liable to you or any third party for any direct or indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising for your use of our Service, even if we have been advised of the responsibility of such damages.

8.2. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you, during the six (6) month period prior to any cause of action arising.

9. Miscellaneous

9.1. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.

9.2. These Terms operate to the fullest extent permissible by law.

9.3. If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of a provision is deemed severable from these Terms and does not affect the validity and enforceability of the remaining provisions.

9.4. We reserve the right, but not the obligation to monitor the Service for violations of the Terms; take appropriate action against anyone who in our sole discretion violates the law or these Term; refuse, restrict, or suspend access to, limit the availability of, or disable your account for not following these Terms.

10. Dispute and Dispute Resolution

10.1. These terms and conditions and the provision of our Service shall be governed by and construed in accordance with Greek law. Any dispute arising out of the Terms shall exclusively be submitted to the competent courts in Athens, Greece.

10.2. We strongly endorse and welcome extrajudicial, friendly dispute resolution. Therefore, we encourage you to approach us for any complain you may have, prior to taking legal action, and we will make every effort to resolve any dispute friendly.

11. Changing and/or Amending these Terms

We may change these Terms at any time at our discretion. In this case, we will provide you with prior notice seven (7) days before the new Terms are applied. By continuing to use the Service after the effective date of the new Terms, you will be assumed to agree, accept, and be bound by the new/modified/amended Terms.
